Personas Terms of Use

Terms of Service ("Terms") Last updated: July 02, 2015 Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the http://www.personas.com website (the "Service”), or the Personas mobile application, operated by Personas ("us", "we", or "our").

At Personas, we believe the purpose of social media is to empower individuals and build communities. We strive to encourage the free flow of information and social change. Our terms of service are designed to give each user the greatest freedom possible while also respecting the rights of all others. The following statement of rights lays out everything we owe you while the corresponding responsibilities explain all the behaviours we expect from each user to ensure that Personas remains safe while welcoming diversity and secure while open to all. Any misconduct (defined as a breach of our policies) will result in the suspension or deactivation of your account.

I. The Right to Privacy

To respect your privacy to the utmost, Personas has been developed to include multiple settings and features to allow users to dictate what information they do and do not share, and with whom. We guarantee we will not allow this information to be accessible to anyone you have not expressly permitted. We guarantee that we will never share your personal information for commercial purposes.

We would like to advise you that our service may contain links to third-party websites or services that are neither owned nor controlled by Personas. As such, Personas cannot assume any responsibility for the privacy policies, content or practices of these third-party websites or services. We strongly urge you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit as we are not liable, directly or indirectly, for any damage or loss caused, or alleged to be caused, by or in connection with the use of or reliance on any content available on or through any such web sites or services.

II. The Right of Ownership

You own all content you upload to Personas and you have the right to your digital image within Personas. If any individual has an image posted of them that they dislike for whatever reason, said person has a right to request the removal of that image and Personas will, within the limits of the law, cause the poster to remove and/or obviscate said image in compliance to the request. Refusal to remove or obviscate a requested image may result in the forced closure of the poster’s account.

However, erroneous or malicious requests for image removal will not be honoured by Personas.

Furthermore, just as we will protect your trademark, copyright and patent rights, we expect you to respect those of others. We reserve the right to remove any content we believe infringes upon the copyright or patent claims or the trademarks of others but you will always have the right to appeal this decision by the process laid out in Section VII: The Right of Appeal.

III. The Right of Expression

We believe in freedom of speech but we do not believe in the right to offend. We encourage you to voice your opinions, thoughts, beliefs and ideas on our social network – Personas has been created for just that purpose. We will not remove content because it is politically challenging, socially disruptive or questions existing power structures. We also will not remove content that presents alternative narratives, celebrates art, exposes injustice or captures the beauty of human experience.

Your online safety is our paramount concern. The responsibilities outlined in the preceding section have been designed to ensure that all users feel secure and comfortable while using our platform.

To further this end, we ask that you guarantee that the information you provide when you register for a Personas account is accurate and up to date. However, it is your prerogative to determine how much information you wish to share on your profile.

Please refrain from using the Personas social network if you are under thirteen (13) years of age. Please note that we have different age restrictions for our payment processing services which are laid out in detail in our payment terms and conditions.

V. The Right to Security

We strive to safeguard your information and keep you and your device safe from any threats. To do so, we will do our best to maintain the integrity of our system.

At the same time, we expect all users to abide by all applicable laws and to refrain from misrepresentation, malicious or discriminatory behaviour and violations of any of our policies when using or accessing Personas. Should we find any breaches in conduct, we reserve the right to suspend or deactivate your account in accordance with the rights laid out in Section VII: The Right of Appeal. VI. The Right of Entry and Exit

We aim to make Personas as accessible as possible, with the greatest number of users able to access our services. You have the right to enter and exit the Personas system at your discretion, as long as you have not been previously suspended or expelled from using our services. We strive to make it as easy as possible for you to deactivate, suspend or reactivate your account. If you have any trouble creating an account, please contact us at support@personas.com. We do require that all users and potential users first review our Terms of Service to ensure that they do not fall into the categories prohibited from use. Should your account be suspended or deactivated because we feel you have violated our policies, you have the Right of Appeal which is further described in the proceeding section.

VII. The Right of Appeal

We will inform you in writing (by an email sent to the email address with which you have registered with Personas) that we have suspended or deactivated your account. We guarantee to explain the reasons for such a decision but reserve the right to immediately suspend or terminate an account because we feel it has violated any of our policies. If you feel your account has been unfairly suspended or deactivated by Personas (i.e. that you have not violated any of our Terms of Service or any other policy), you have the right to appeal this action. Please send us an email from the email account with which you registered detailing your situation and any concerns you may have. We promise to respond to any such appeals and guarantee we will review the circumstances of said suspension or deactivation. Should we find that your appeal is legitimate, we are responsible for restoring your account. However, should we review your appeal and abide by our decision, your Personas account will remain suspended or deactivated as the case may be. Please note that all provisions of our policies which by their nature should survive termination shall survive termination including but not limited to: ownership provisions, warranty disclaimers, indemnity and limitations of liability.

VIII. Further Provisions

Please note that Personas.com Corp is a company based in Ontario, Canada and as such, all of our policies (including these Terms of Service and our Payment Terms) are to be governed and construed in accordance with the laws of Ontario. Any delay or oversight in enforcing any right or provision of our Terms is not to be considered a waiver of those rights or provisions by either ourselves or our users. If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

In order to better serve our users and enhance the Personas experience, we reserve the right to update our system from time to time. To continue using our service, you may be asked to update to a newer version. We will require your consent each time and you are always free to refuse.

Should we expand or update our Terms of Service, we will inform you by posting a notice on our home page. We will highlight the amendments on the Terms of Service page such that users can clearly see what has been changed, added, omitted, or expanded.

If you use a Personas payment processing application to purchase any goods or services, you agree to our Payment Terms.
